Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Detention

Courtroom proceedings

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.

The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling charges, he was held in federal detention.

In her order, the judge noted that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Background of the Case

The legal proceedings center on conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.

Conditions of Freedom

The court, who was overseeing his challenge to deportation in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.

This ruling represents a significant development in a complicated immigration case featuring claims of mistaken imprisonment and disputed gang affiliations.
